Privacy Policy

Following are extracts from Harbour IT's terms and conditions (FY2009). If you were connected to Harbour IT's satellite service prior to 4 August 2008, please note that these terms may vary slightly. If you wish to be provided with a copy of the specific privacy policy that applies to you, please send a request to hit.operations@harbourit.com.au.

10. PRIVACY AND PERSONAL INFORMATION

10.1 Harbour IT may collect, use and disclose Personal Information about You, to decide whether to start, stop or limit supply to You of:

  • (a) personal or commercial credit;
  • (b) the Service; or
  • (c) the products and services of other Harbour IT Group Companies.

10.2 Harbour IT may collect, use and disclose Personal Information about You for purposes related to the supply of the Service (or for purposes which would be reasonably expected) including billing and account management, business planning and product development, and to provide You with information about promotions, as well as the products and services of Harbour IT Group Companies and other organisations.

10.3 Harbour IT may collect, use and disclose Personal Information about You for the purposes in clauses 10.1 and 10.2 to or from:

  • (a) a credit reporting agency or credit provider;
  • (b) another Harbour IT Group Company;
  • (c) third parties who are not related to Harbour IT, including Harbour IT's agents, dealers, contractors and franchisees;
  • (d) Suppliers who need access to the Personal Information to provide Harbour IT with services, to allow supply of the Service to You; and
  • (e) joint venture partners of Harbour IT Group Companies.

10.4 Harbour IT may be permitted or required by applicable laws to collect, use or disclose Personal Information about You, including:

  • (a) to the operator of the Integrated Public Number Database (IPND), which supplies information for telephone directories; and
  • (b) to law enforcement agencies for purposes relating to the enforcement of criminal and other laws.

10.5 If You are a natural person, You are entitled to gain access to Your Personal Information held by Harbour IT, unless Harbour IT is permitted or required by any applicable law to refuse such access.

10.6 If You do not provide part or all of the Personal Information Harbour IT requests, then Harbour IT may refuse to supply, or limit the supply to You of:

  • (a) personal or commercial credit;
  • (b) the Service; or
  • (c) the products and services of other Harbour IT Group Companies.

By providing Personal Information to Harbour IT and obtaining the Service, You acknowledge and consent to the collection, use and disclosure of Your Personal Information as set out in this clause 10 and in accordance with the Harbour IT privacy policy.

19. CONFIDENTIALITY

19.1 Harbour IT and You each agree to keep confidential the other's Confidential Information except to the extent of clause 10, to the extent that the disclosure is required by law or the rules of a stock exchange, by a government authority or Regulator or to professional advisors in connection with this Agreement.

19.2 Subject to clauses 9 and 19.1, Harbour IT and You will not use or disclose the other's Confidential Information for any purpose, other than to the extent necessary to perform its obligations or exercise its rights under the Agreement.
